In the wake of the mass shooting in Maine, President Joe Biden has once again urged the public and lawmakers to combat gun violence by instituting more gun control.
In the president’s statement published by the White House, Biden expressed his condolences to the victims and their families. (Related: Suspect in Maine mass shooting found DEAD.)
Moreover, the president acknowledged the need for stronger gun control laws, referencing the passage of a gun control measure in the summer of 2022 that he had worked on with Sen. John Cornyn of Texas. He emphasized that while progress had been made, more needed to be done. So he insisted on collaborating with Republicans on a new bill to further reduce gun violence in the country.
“I urge Republican lawmakers in Congress to fulfill their duty to protect the American people. Work with us to pass a bill banning assault weapons and high-capacity magazines, to enact universal background checks, to require safe storage of guns, and end immunity from liability for gun manufacturers. This is the very least we owe every American who will now bear the scars – physical and mental – of this latest attack,” Biden said in a statement.
Biden has renewed his call for the repeal of certain legal protections for gun manufacturers and universal background checks to curb gun violence.
During his 2022 State of the Union address, Biden called for the repeal of the liability shield for gun manufacturers, a call he has made multiple times in the past.
“We should eliminate gun manufacturers from the immunity they receive from Congress. Most people don’t realize, the only industry in America, a billion-dollar industry, that can’t be sued are gun manufacturers.”
However, the claims are proven fake, as gun manufacturers are not immune to liability but are protected from frivolous lawsuits related to legally manufactured and sold firearms.
The Protection of Lawful Commerce in Arms Act (PLCAA), a law that he campaigned on repealing, shields gunmakers from lawsuits in cases where legally manufactured and sold firearms are used in criminal activities.
For instance, if a handgun legally produced and distributed to a Federal Firearms License holder is subsequently sold following a National Instant Criminal Background System (NICS) check to an individual at retail and then used in a crime, the manufacturer is protected from lawsuits. So is the gun manufacturer in the Lewiston shootings.
“Businesses in the United States that are engaged in interstate and foreign commerce through the lawful design, manufacture, marketing, distribution, importation or sale to the public of firearms or ammunition products that have been shipped or transported in interstate or foreign commerce are not, and should not, be liable for the harm caused by those who criminally or unlawfully misuse firearm products or ammunition products that function as designed and intended,” the PLCAA stated.
Furthermore, the PLCAA does not provide gun manufacturers with “legal immunity” from lawsuits related to defective products or criminal misconduct on their part. Meaning to say, this evidence debunked Biden’s claims that they are entirely shielded from liability.
